Fort Smith Police say a man is dead after he was shot by an officer this afternoon during a domestic disturbance.
41-year-old Eric Berry was shot and killed after an altercation with police at 8500 South 35th Terrace in Fort Smith around 11:30 a.m. Police had been called to that location by Berry's wife, Connie Berry, who claimed her husband had been chasing her with a gun.
"When three of the officers entered the residence, they were assaulted by the suspect with a semi-automatic handgun, and then the officers felt that they were threatened," said Sergeant Levi Risley.
Earlier Wednesday morning, police say Berry's wife came to the police station to file a domestic violence report. She claimed that morning her husband had hit her in the head and tried to smother her with a pillow, then threatened to kill her son if she told police.
Two officers went out to Berry's house to arrest Eric and allow Connie to get her things, but were called back when Connie told police she didn't want to follow through with the report.
Police say Connie did return home later, and after about an hour officers received a 911 call from her neighbor's house. Eric Berry had reportedly chased his wife out of the house with the gun, and she had run to her neighbor's house to call police.
Officers went back out to Berry's house, where investigators say they were confronted by Eric Berry, and Corporal Brandon Davis used deadly force to subdue him.
Investigators are now going through the house to make sure the physical evidence answers all their questions, and using cutting-edge technology to do so.
"They're actually using some new equipment right now, they're working on creating a 3D rendering of the inside of the residence," said Sgt. Risley.
It's the second shooting in as many weeks involving Fort Smith Police. On November first, Corporal Barney Parsons was shot four times during a routine traffic stop. The suspect, 25-year-old Tristan Honey of Fort Smith, was later arrested in New Mexico.
